1. Acceptance of Terms
By accessing or using Creatar AI ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service. These terms apply to all users, including visitors, registered users, and paying subscribers.
2. Description of Service
Creatar AI is an AI-powered video generation platform that enables users to create professional videos using artificial intelligence technologies including AI avatars, voice synthesis, and automated editing. The Service provides workflow tools, scheduling, and content management features.
3. User Accounts
You must create an account to use most features of Creatar AI. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. You must provide accurate and complete information when creating your account.
4. API Keys & Third-Party Services
Creatar AI operates on a Bring Your Own Key (BYOK) model. You are responsible for obtaining and maintaining your own API keys from third-party services including but not limited to HeyGen, Kling AI, ElevenLabs, OpenAI, and Google AI. You are solely responsible for any costs incurred through your use of these third-party services. Creatar AI does not control and is not liable for third-party service availability, pricing changes, or terms of service.
5. Content Ownership
You retain full ownership of all content generated through Creatar AI using your API keys and inputs. Creatar AI does not claim any ownership rights over your generated videos, scripts, or other content. You are responsible for ensuring your generated content complies with applicable laws and the terms of the underlying AI services.
6. Acceptable Use
You agree not to use Creatar AI to: generate content that is illegal, harmful, or violates the rights of others; impersonate real individuals without their consent; create deepfakes or misleading content intended to deceive; violate the terms of service of connected third-party APIs; attempt to reverse-engineer, disrupt, or exploit the Service; or share your account credentials with unauthorized parties.
7. Payment Terms
Paid subscription plans are billed on a recurring basis (monthly or annually) as selected at the time of purchase. All fees are non-refundable except as required by law. We reserve the right to change pricing with 30 days' notice. Free tier accounts are available with BYOK functionality at no cost.
8. Limitation of Liability
Creatar AI is provided "as is" without warranties of any kind. We are not liable for any indirect, incidental, special, or consequential damages arising from your use of the Service. Our total liability shall not exceed the amount you paid to us in the 12 months preceding the claim. We are not responsible for failures or costs related to third-party API services connected through your keys.
9. Termination
We may suspend or terminate your account if you violate these terms. You may cancel your account at any time through Settings > Account. Upon termination, your right to use the Service ceases immediately. We may retain certain data as required by law or for legitimate business purposes.
10. Changes to Terms
We may update these Terms of Service from time to time. We will notify registered users of material changes via email or in-app notification. Continued use of the Service after changes constitutes acceptance of the updated terms.
